For the past 10 years of my almost 3 decade career, I have been focused on the special needs of families in probate. Unfortunately, about 60% of baby boomers in Florida do not have an estate plan of any kind, meaning that their estate will have to go through the probate courts for settlement. Of those that have a will, only 40% have a trust. When you die with a will, it must be validated by the court and still go through the probate process. If you have a well-drawn trust, no probate is necessary.
